Well, the Canada immigration website claims that counsel is not mandatory. However, they don’t tell you that they won’t help in case of finding any mistake in your application. The reason is simple—they are not here to counsel or help anyone. Contact them and you will get conflicting and confusing replies.

While immigration consultants can represent you, only lawyers are allowed to represent you in federal court. A consultant can handle all types of appeals. But certain categories of failed applications can only be handled in Federal Court, and only a lawyer can represent you. For example, an immigration lawyer can represent you if you have medical concerns, prior refusal or a criminal conviction. 

No. Canada immigration will always require substantial documentation to prove that your relationship is both genuine and ongoing. You are allowed to stay for 6 months as a visitor in case you have the stamp on a passport with no special notations to the contrary. Therefore, you need to leave Canada or apply to extend your staying period before the expiry date. 

NO. Study permits are not required for the courses that start and end during your stay as a visitor after your initial entry to Canada. 

Visitors are NOT allowed to turn into a worker. However, a visitor can apply for a work permit for the highly skilled positions in the NOC levels O, A or B and the areas where there is a labour shortage in Canada. But it requires them to be qualified and educated for the job. 

If you have already received a work permit, contact us so that we can guide you on how to apply for an Approval in Principal AIP work permit before the expiry of your existing one which lets you continue to work. 

 

Otherwise, you can apply for a Work Permit for NOC O, A or B level position already under the normal LMIA criteria based on your work, education in a skilled profession and labour market shortage, and your employer’s willingness to sponsor an LMIA for you. If you still don’t qualify, wait and apply for an open work permit only after you get “approval in principle”.

We advise you to limit your inquiries as possible. This is because unnecessary frequent inquiries can only lead to frustration among immigration staff. And this is likely to impact their decision. 

 

If you have a question, ask if your waiting time is expected according to the norm of that visa post as well as the category of application. 

In this scenario, it is important to check the causes of failures in your first application. You CANNOT RE-APPLY for some applications such as refugee claims.

 

For others, you are required to appeal within the set periods by Canada Immigration. If there was no flaw in your first application, and the grounds for the original application are still available, you can apply for a new application.

A valid PR or permanent resident card is required to return to Canada by train, plane, boat or bus. Make sure to renew your card before leaving if it is expired. The card can only be renewed in Canada. PR cards are not sent to non-Canadian addresses. If you are outside Canada and lack a valid PR card, you can use a PRTD (Permanent Resident Travel Document) to return to Canada. You can only apply for a PRTD from outside Canada. If you are a person between the ages of 18 and 54 the day you sign your application, you are required to meet the Canadian Language Benchmarks Level 4 (CLB 4) or higher in speaking and listening. To become a citizen of Canada, you should be efficient in English or French as well as be able to provide citizenship application, proof that you can speak and listen in English or French at CLB/NCLC 4 level or higher. 

Only a doctor approved by IRCC is allowed to do the immigration medical exam. This doctor is termed as a panel physician. Here is a list of approved panel physicians being available across the world. A family doctor is not allowed unless his or her name is on the list. You are also required to pay for medical tests. 

All candidates who are approved for a multiple entry visa will be provided with one. But not all candidates will be approved for multiple entry visas. Well, this depends on the discretion of a visa officer. A single entry visa might be issued in cases where, for instance:

 

  • A candidate is qualified for a free exemption and where the purpose of entry to Canada is limited.
  • A candidate is a participant in a special gaming event in Canada. 
  • Nation-specific procedures or guidelines are set and approved by IRCC.
